As far as I know it doesn't. And I doubt that it ever will. I
somewhy think you did delete too much of the context. The talk was about
German laws, software licences (or the lack of those) and whetever or not
any company could sell a "value added" version of gcc, not distribute the
sources (or not allow you to do so) and get away with it. I *do* think
that it may be possible in some cases. And yes, all these cases are in
violation of the licence. Which in most cases again means nothing if the
judge thinks otherwise.
