The GPL allows them to do this.

I can modify GCC and refuse to give it to you for less than $1,000,000.
*If* I give this version to you, I *must* supply source and *you* are allowed 
to give it away for free.   As far as I see it the company you are talking 
about is conforming to the letter if the GPL.  

Just ask them for a  list of satisfied customers & ask one of them for the 
source + code.  They are allowed  to give it to you.  They may not want to -- 
it's their choice.
