Yes.

No.

I am concerned about the development of such anti-commercial licenses in
this product, because I want to some day be able to buy or recommend to
my non-computer-literate relatives a UNIX like novice-friendly O/S. If
386BSD gets encumbered with lots of little licensing restrictions this
will never happen.

If you want to form your own Free Software Foundation, go ahead. But don't
try to turn this into one.
